According to several top US Attorneys, District Courts were assured by the Trump Administration late on Friday evening that Busloads of Migrants driven to a Texas Detention Center would not be illegally deported on Friday night. via flights like the ones several weeks ago to one of the most notorious prisons in the world, claiming that they were subject to an obscure "Alien Enemies Act of 1798 intended for use only during significant a declared War Time" However, in a true case of "the Devil is in the details", they added "But we cannot confirm that it won't happen on Saturday".
Given that the administration also had misunderstood their previous demand that they "Facilitate" the return of a Maryland migrant that was deported by mistake, they added wording that could not be misunderstood, stating that they are "not to move any of those migrants unless they are told to do so by this Court." Andrew Weismann, a former Assistant US Attorney from 1991 to 2002, an NYU Law Professor, and very experienced in organized crime cases said during a podcast yesterday on Main Justice that the Supreme Court's decision was just in the nick of time. In a ruling earlier in April the Courts had also told the administration that they could not remove any migrants without giving ample time for each migrant to have a hearing where their case could be debated. US Protesters have taken to peaceful assemblies where they carry large "Due Process is the Law in America" signs and signs saying "Americans don't just disappear".
Weismann praised the Court, saying that this new batch of detainees now being held at Bluebonnet Detention Center may have had mere minutes to spare from being deported literally and figuratively in the middle of the night, without due process. Weismann also clarified that the word "Facilitate" is an "active verb".
Supreme Court Justices Thomas and Alito dissented.
